ORDINANCE NO. BL2005-773

An ordinance authorizing the Metropolitan Government to participate with Centex Homes to provide public sewer service in Davidson County to Hills of Concord Place, Phase One and Two, and Villas of Concord Place, Phase Three, Subdivision Project No. 05-SL-47.

WHEREAS, Centex Homes has expressed a desire to provide public sewer service in Davidson County, Tennessee, to a development known as Hills of Concord Place, Phase One and Two, and Villas of Concord Place, Phase Three, Subdivision Project No. 05-SL-47; and

WHEREAS, this project is deemed to benefit both parties and the general community, and Centex Homes agrees to pay an amount not to exceed $44,000.00.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Centex Homes, to provide public sewer services in Davidson County, Tennessee, to a development known as Hills of Concord Place, Phase One and Two, and Villas of Concord Plase, Phase Three, Subdivision Project No. 05-SL-47, attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $44,000.00 is to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335, for a total of 22 single-family home connections..

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
