ORDINANCE NO. BL2005-775

An ordinance abandoning a 8 inch, 10 inch and a 12 inch sanitary sewer line and easement that will be replaced by a 8 inch and 10 inch sanitary sewer line and easement, that is shown on Map 104-2, Parcels 384, 388, 389, and 390 and Map 104-3, Parcels 17 and 18, Project 05-SL-57, Bristol-West End, and authorizing the execution of the documents to carry out the abandonment. (Proposal No. 2005M-096U-10).

WHEREAS, a 8 inch, 10 inch and 12 inch existing sanitary sewer line and accompanying easement, more particularly described in Project No. 05-SL-57, Bristol-West End, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, a relocated sanitary sewer line of equal size will be replacing the existing 8 inch and 10 inch sanitary sewer line and easement; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2005M-096U-10 on May 20, 2005 for abandonment of said easement and sanitary sewer line.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government hereby abandons the 8 inch, 10 inch and 12 inch sanitary sewer line and the easement shown on Map104-2, Parcels 384, 388, 389, and 390 and Map 104-3, Parcels 17 and 18, Project No. 05-SL-57, Bristol-West End as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

SECTION 2: That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
