ORDINANCE NO. BL2005-772

An ordinance approving the donation of a certain surplus Massey Ferguson tractor from the Metropolitan Government of Nashville and Davidson County to the Andrew Jackson Police Youth Camp, Inc., a nonprofit charitable organization.

Whereas, the Metropolitan Government of Nashville and Davidson County owns a 1981 Massey Ferguson 255 tractor (hereinafter "tractor") that has been deemed surplus by the Department of Parks and Recreation; and

Whereas, the Metropolitan Government of Nashville and Davidson County has determined that the tractor is no longer needed for general governmental purposes; and

Whereas the Andrew Jackson Police Youth Camp, Inc., is a nonprofit charitable organization that is exempt from federal income taxes under section 501(c)(3) of the Internal Revenue Code; and

Whereas the Andrew Jackson Police Youth Camp, Inc., provides a youth camp for underprivileged children in Davidson County; and

Whereas, the Department of General Services has been contacted by the Andrew Jackson Police Youth Camp, Inc., which wishes to use the tractor at its youth camp facility located on Old Hickory Lake; and

Whereas the transfer of the surplus tractor to the Andrew Jackson Police Youth Camp, Inc., would benefit the citizens of the Metropolitan Government of Nashville & Davidson County; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government to authorize the donation of the surplus tractor to the Andrew Jackson Police Youth Camp, Inc.

Now, therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Government of Nashville and Davidson County is hereby authorized to donate a surplus 1981 Massey Ferguson 255 tractor to the Andrew Jackson Police Youth Camp, Inc., for use at its youth camp facility.

Section 2. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
