ORDINANCE NO. BL2005-731

An ordinance approving a contract by and between The Metropolitan Government of Nashville and Davidson County and Loss Prevention Specialists, Inc. for recovery of funds belonging to the Metropolitan Government.

Whereas, Loss Prevention Specialists, Inc. is a detective agency that specializes in locating and recovering funds that are owed to or otherwise belong to governments and corporations; and,

Whereas, representation of Loss Prevention Specialists, Inc. have contacted officials of the Metropolitan Government with an offer to recover the sum of $13,607 belonging to the Metropolitan Government that they had located for the consideration of twenty percent (20%) of the amount recovered; and,

Whereas, the Metropolitan Department of Law and Loss Prevention Specialists, Inc. have negotiated a contract that is acceptable to each party; and,

Whereas, it is in best interest of the Metropolitan Government to employ Loss Prevention Specialists, Inc. to recover the above-referenced funds on behalf of the Metropolitan Government.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1: That the contract by and between The Metropolitan Government of Nashville and Davidson County and Loss Prevention Specialists, Inc., for recovery of $13,607, and for consideration of a Finder's Fee in the amount of twenty percent (20%) of the amount recovered, which contract is attached hereto and made a part of this ordinance is hereby approved.

Section 2: That any amendment to the contract approved herein may be approved by resolution of the Metropolitan Council receiving twenty-one (21) affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2005-731 as follows:

1. By changing Section 3 to be numbered Section 4.

2. By adding a new Section 3, to state as follows:

Section 3: That the Metropolitan Council does not grant Loss Prevention Specialists, Inc. any authority to negotiate or enter into any settlement agreement on behalf of The Metropolitan Government of Nashville and Davidson County.
