ORDINANCE NO. BL2005-769

An ordinance amending the Metropolitan Code of Laws Section 15.40.020, to authorize the Director of the Metropolitan Public Health Department to jointly enforce Chapter 15.40 of the Metropolitan Code of Laws with the Director of Water and Sewerage Services.

WHEREAS, the Department of Water and Sewerage Services and Metropolitan Public Health Department have agreed that the changes set forth below to the Metropolitan Code of Laws are needed to protect public health; and

WHEREAS, the proper treatment of sanitary sewage is a public health issue in the Metropolitan Government, and the Metropolitan Public Health Department needs authority to require connection to the public sanitary sewerage system.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Metropolitan Code Section 15.40.020 is amended by including the following at the end of the Section: The director of the Metropolitan Public Health Department may require connection to the public sewerage system in accordance with this chapter when public health concerns are identified.

SECTION 2. This ordinance shall take effect from and after its final passage the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
