RESOLUTION NO. RS2005-1011

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to take the action necessary to divert one cent of the state gasoline tax collected in Davidson County to the Metropolitan Nashville Public Schools.

WHEREAS, Tennessee Code Annotated §67-3-201 provides for a privilege tax of twenty cents per gallon on all gasoline sold in Tennessee; and

WHEREAS, Tennessee Code Annotated §67-3-202 provides for a use tax of seventeen cents per gallon for all diesel fuel consumed in Tennessee; and

WHEREAS, the Metropolitan Government is limited in its taxing authority to ad valorem property taxes, the local option sales tax, and the vehicle regulatory license fee; and

WHEREAS, the State of Tennessee has consistently been ranked as having some of the best roads in the country, while at the same time ranking at the bottom in education; and

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County that state law be amended to divert a portion of the state gasoline tax collected in Davidson County away from constructing state roads and highways and toward educating children.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to take the action necessary to divert one cent of the state gasoline tax collected in Davidson County to the Metropolitan Nashville Public Schools.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
