RESOLUTION NO. RS2005-1003

A resolution approving and authorizing the Mayor to execute a local government investment pool agreement with the State of Tennessee Department of Treasury for the deposit of local share funds for the replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31) (PIN 106007.00).

WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") desires to enter into a contract with the Metropolitan Government for the replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31) (PIN 106007.00) ("Project"), which contract provides for cost-sharing by the Metropolitan Government; and

WHEREAS, Ordinance No. O85-740 provides that Local Government Investment Pool Agreements with the State of Tennessee, Department of Treasury, for the deposit of local share funds relative to Tennessee Department of Transportation projects must be approved by Resolution of Council prior to execution of the same by the Metropolitan Mayor; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve an agreement with the State of Tennessee, Department of Treasury, for the deposit of the Metropolitan Government's funds pertaining to the Project, a copy of which is attached hereto.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the local government investment pool agreement between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee Department of Treasury concerning Federal Project No: BRZE-9312(69), replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31) ("Project"), as attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
