ORDINANCE NO. BL2005-786

An ordinance approving and authorizing the Mayor to execute a contract with the State Department of Transportation for replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31) in accordance with Federal Project No: BRZE-9312(69), and providing for approval of future related agreements by Resolution of Council.

WHEREAS, improvements are needed for the bridge on Battery Lane over Brown's Creek (LM 4.31); and

WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") desires to enter into a contract with the Metropolitan Government for the purpose of providing for management, funding, and related matters for the necessary bridge replacement work; and

WHEREAS, the terms of the contract ("Contract") attached as Exhibit A and incorporated into this ordinance by reference, provide that twenty percent (20%) of the actual cost for the bridge improvements will be paid by the Metropolitan Government and that eighty percent (80%) of the actual costs of the project will be paid from 23 U.S.C.A. 144, Highway Bridge Replacement and Rehabilitation Program funds ("Funds") subject to allocation by TDOT, with the Metropolitan Government to pay one hundred percent (100%) of costs following expenditure of such Funds; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve the contract with TDOT for the replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee Department of Transportation concerning Federal Project No: BRZE-9312(69), replacement of the bridge on Battery Lane over Brown's Creek (LM 4.31) ("Project"), attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Contract must be approved by Resolution of the Metropolitan Council.

Section 3. That all agreements between the Metropolitan Government and any other party pertaining to this Project may be approved by Resolution of the Metropolitan Council.

Section 4. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
