ORDINANCE NO. BL2005-799

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new Fire Station in the Neely's Bend Road area ( Proposal No. 2005M-174G-04).

Whereas, the Metropolitan Government is given the power by Sections 2.01(12), (5) of the Metropolitan Charter to provide for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose, when the public convenience requires it and in accordance with the provisions of Tennessee Code Annotated, Section 29-16-101 et seq., and also the power to purchase real property for any public purpose; and,

Whereas, under Section 8.302 of the Metropolitan Charter, the Fire Department is charged with the responsibility of protecting against fire within the urban services district and within other areas covered by contracts authorized by ordinance; and,

Whereas, it is in the public interest that certain properties, identified as Parcels 171.00, 172.00 & 173.00 on Tax Map 043-15-0, approximately 2.61 acres, be acquired through negotiation or condemnation for the construction of a new Fire Station in the Neely's Bend Road area; and,

Whereas, the funds to defray the cost of this public project are available from Fund Number 48170, Business Unit Number 15494114;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Director of Public Property Administration, or his designee, is hereby authorized to execute the necessary documents to acquire by negotiation or condemnation the properties as attached in Exhibit A.

Section 2. That any amendments to this ordinance shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson requiring it.
