ORDINANCE NO. BL2005-790

An ordinance authorizing the Director of the Division of Public Property Administration and the Director of Parks and Recreation, or his designee, to accept and record easements from The Donelson Civitan Foundation in favor of the Metropolitan Government for use in connection with development of the Stones River greenway (Proposal No. 2005M-147U-14).

Whereas, the owner of certain real properties identified in the document attached as Exhibit A to this ordinance have agreed to donate easements to the Metropolitan Government for use in connection with development of the Stones River greenway; and

Whereas, each of the easements will be dedicated with a separate agreement substantially in the form of the document attached as Exhibit B to this ordinance; and

Whereas, the citizens of Nashville and Davidson County will benefit by accepting the donated easements.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Director of the Division of Public Property Administration and the Director of Parks and Recreation, or his designee, are authorized to accept and record easements from the owner of certain real properties described in Exhibit A. Each of the easements shall be dedicated with an agreement substantially in the form of Exhibit B.

Section 2. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
