ORDINANCE NO. BL2005-792

An ordinance authorizing the Metropolitan Government to participate with Tiara Development to provide public sewer service in Williamson County to Willoment Subdivision, Phase Five, Project No. 04-SL-125.

WHEREAS, Tiara Development has expressed a desire to provide public sewer service in Williamson County, Tennessee, to a development known as Willoment Subdivision, Phase Five, Project No. 04-SL-125; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, has built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000.00 per connection towards the cost of the Owl Creek Project; and

WHEREAS, this project is deemed to benefit both parties and the general community, and Tiara Development agrees to pay an amount not to exceed $78,000.00 for a total of 39 single-family home connection.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The participation agreement with Tiara Development, to provide public sewer services in Williamson County, Tennessee, to a development known as the Willoment Subdivision, Phase Five, Project No. 04-SL-125 attached hereto and incorporated herein, is hereby approved and the Director of Water and Sewerage Services is authorized to execute the same.

SECTION 2. That the $78,000.00 is to be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
