RESOLUTION NO. RS2005-994

A resolution requesting Nashville Electric Service to relocate the substation currently located behind the new Ben West Building.

WHEREAS, Nashville Electric Service currently maintains and operates an electric power substation directly behind the Ben West Building, which is located at 100 James Robertson Parkway; and

WHEREAS, the Metropolitan Government is in the process of constructing a new 235,000 square foot building adjacent to the Ben West Building, which will house sixteen courtrooms for the criminal and general sessions courts; and

WHEREAS, this new criminal court building is to be completed in the Spring of 2006; and

WHEREAS, the Metropolitan Government is also in the process of making substantial renovations to the historic courthouse; and

WHEREAS, the substation located behind the Ben West Building will obstruct the view from the new criminal court building, and is not in character with the surrounding development; and

WHEREAS, it is fitting and proper that Nashville Electric Service find a more suitable location for this substation.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting Nashville Electric Service to relocate the substation currently located behind the new Ben West Building.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to Decosta Jenkins, the President and Chief Executive Officer of Nashville Electric Service.

Section 3. That the President and Chief Executive Officer of Nashville Electric Service is further requested to respond to the Council regarding the request identified in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County.
