Metropolitan Council Meeting
Tuesday, April 19, 2005


 The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Father Mark Hunt of Father Ryan High School.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Electrical Examiners and Appeals Board
Appointment of Mr. Jim Seabury for a term expiring February 15, 2009. Mr. Seabury will serve as a non-union electrical contractor representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Jimmy Stansell Jr. for a term expiring February 15, 2009. At the request of the appointee, the nomination was deferred.

Board of Fair Commissioners
Appointment of Mr. Dean Thompson for a term expiring April 6, 2010. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board
Appointment of Ms. Anna Parson-Elsberry for a term expiring May 5, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Kay West for a term expiring May 5, 2006. Fire and Building Code Appeals Board
Appointment of Mr. Chris Remke for a term expiring March 1, 2009. Mr. Remke will serve as the architect representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Lee Steinhouse III for a term expiring March 1, 2009. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Parks and Recreation
Reappointment of Mr. Stanley Fossick for a term expiring April 30, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Traffic and Parking Commission
Reappointment of Ms. Gwen McFarland for a term expiring April 3, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Coleman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.


- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

A proposed amendment to Rule No. 1 and Rule No. 27 of the Rules of Procedure of the Metropolitan Council will be considered at the next regular meeting.

- RESOLUTIONS -

RESOLUTION NO. RS2005-778

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The Charter Revision Committee recommended indefinite deferment. Ms. Gilmore moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.

The Clerk reported that the following bids were received on this date for sale of The Metropolitan Government of Nashville and Davidson County's $341,455,000 General Obligation Bonds, Series 2005A, and General Obligation Refunding Bonds, Series 2005B.

Ms. Gilmore offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted without objection.

BILL NO. BL2005-636

An ordinance amending Section 10.20.300 of the Metropolitan Code of Laws regarding dumpster-type containers located within three hundred feet of a residential structure, all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works Committee by a voice vote of the Council.

BILL NO. BL2005-637

An ordinance amending Section 12.40.040 of the Metropolitan Code by permitting parking within the Central Business Improvement District during certain evenings in some spaces where parking is now prohibited. Upon motion duly seconded, the bill passed first reading and was referred to the Traffic and Parking Committee by a voice vote of the Council.

BILL NO. BL2005-638

An ordinance amending Section 2.108.020 of the Metropolitan Code of Laws to provide for the Health, Hospitals and Social Services Committee and the Personnel-Public Information-Human Relations-Housing Committee of the Metropolitan Council to each elect one of its members to serve on the Metropolitan Action Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Health, Hospitals and Social Services and Personnel-Public Information-Human Relations-Housing Committees by a voice vote of the Council.

BILL NO. BL2005-639

An ordinance amending Chapter 2.64 of the Metropolitan Code of Laws to prohibit members of Metropolitan Government boards and commissions, other than those boards and commissions created by the Metropolitan Charter, from serving more than two consecutive terms. Upon motion duly seconded, the bill passed first reading and was referred to the Rules-Confirmations-Public Elections Committee by a voice vote of the Council.

BILL NO. BL2005-640

An ordinance authorizing the Metropolitan Department of Law to compromise and settle the claim of Calvin B. Champion, personal representative of the estate of Calvin D. Champion, deceased, against Officers Debbie Miller, Craig Dickhaus and Richard Woodside for the sum of $400,000, which shall be paid from the Police Professional Liability Fund. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2005-641

An ordinance authorizing the Mayor to execute Utility Relocation Contract No. 6504 with the State of Tennessee, Department of Transportation, Project No. 19017-2225-04, 19017-4224-04 Slide Repair 9 Mile Hill (LM 9.2). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council, with Mr. Adkins abstaining.

BILL NO. BL2005-642

An ordinance to amend the Geographical Information Systems Map for The Metropolitan Government of Nashville and Davidson County, by renaming the private drive, Denton Allen Road to Briar Patch Lane (Proposal No. 2005M-051G-01). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Emergency Communications District Board, Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2005-643

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning the North 3rd Street right-of-way from Grace Street South to the dead end (Proposal No. 2005M-056U-05). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Traffic and Parking Commission, Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees by a voice vote of the Council.
