ORDINANCE NO. BL2005-585

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to enter a lease agreement with Two Rivers Corporate Centre, L.P. (Proposal 2005M-069U-14).

WHEREAS, Two Rivers Corporate Centre, L.P. ("Two Rivers") owns certain real property located at 2501 McGavock Pike, Nashville, Tennessee, 37214, commonly known as Two Rivers Corporate Centre, shown on Exhibit A hereto; and

Whereas, the Metropolitan Government desires to enter into an agreement to lease a portion of the property comprising office space; and

Whereas, the parties propose to memorialize the agreement with a lease in the form of the document attached as Exhibit B and incorporated herein by reference.

Now, therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County, Tennessee:

Section 1. The Metropolitan Government is authorized to lease the property, shown on Exhibit A, from Two Rivers Corporate Centre, L.P. pursuant to an agreement in substantially the form of Exhibit B, and the Director of Public Property Administration is authorized to execute the same.

Section 2. Any amendments to the lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2005-585

Mr. President:

I move to amend Ordinance No. BL2005-585 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1.:

"Section 1. The Metropolitan Government is authorized to lease the property, shown on Exhibit A, from Two Rivers Corporate Centre, L.P. pursuant to an agreement in substantially the form of Exhibit B, and the Director of Public Property Administration is authorized to execute the same, provided the Metropolitan Board of Public Education is able to secure private funding for the lease in the amount of $206,669.00 for Year 1, $212,302.38 for Year 2, $218,048.43 for Year 3, $223,909.40 for Year 4, and $229,887.58 for Year 5. The Metropolitan Board of Public Education shall provide documentation of the receipt of said private funding to the Director of Finance, with a copy of such documentation to the Metropolitan Council, which documentation shall be satisfactory to the Director of Finance as to the receipt and amount of said funding."
