ORDINANCE NO. BL2005-508

An ordinance to amend Metropolitan Code of Laws Section 15.60.180(I) (3) relative to the ammonia surcharge.

WHEREAS, Metropolitan Ordinance BL2001-778 established a surcharge for ammonia discharge; and

WHEREAS, an outside rate consultant for the Department of Water and Sewerage Services recommended that this surcharge be revised, to reflect actual costs; and

WHEREAS, The Waste Water Hearing Authority on October 7, 2004, approved this bill amending Title 15.60 as contained herein; and

WHEREAS, 15.60.350(D)(1) required the Waste Water Hearing Authority to recommend to the Metro Council any amendment or modification to Title 15.60; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That Metropolitan Code of Laws 15.60.180(I)(3) is amended by deleting “Ammonia’s surcharge will be 4.6 times the rate for BODs.”, and substituting therein “Ammonia surcharge will be set annually by the Department of Water and Sewerage Services, based on the actual cost of treatment.”

SECTION 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2005-508 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

SECTION 1. That §15.60.180(I)(3) of the Metropolitan Code of Laws be and the same is hereby amended by deleting the phrase "Ammonia's surcharge will be 4.6 times the rate for BODs.", and substituting in lieu thereof the phrase "Ammonia surcharge shall be based on the actual cost of treatment and will be set annually by the Department of Water and Sewerage Services, subject to approval by resolution of the Metropolitan Council receiving twenty-one (21) affirmative votes."
