An ordinance abandoning a fifteen-foot stormwater drainage easement on Map 130-04, Parcel 108.00, and authorizing the acceptance of replacement twenty-foot easements on Map 116-16, Parcel 164.00 and Map 130-04, Parcel 108.00, as shown on the plans for Project 04-DL-0782, Darren Cioffi, and authorizing the execution of the documents necessary to carry out the abandonment (Proposal No. 2004M-066U-10).

WHEREAS, a fifteen-foot stormwater drainage line located on Map 130-04, Parcel 108.00 and accompanying easement, more particularly described in the plans for Project No. 04-DL-0782, Darren Cioffi, on record in the department of Water and Sewerage Services and incorporated herein by reference, are no longer being used by the Department of Water and Sewerage Services nor any other public utility; and

WHEREAS, grants of twenty-foot easements have been executed by the respective property owners and offered to the Metropolitan Government, which easements are described in the plans for Project No. 04-DL-0782, Darren Cioffi, on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto; and

WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-066U-10 on August 12, 2004.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan Government hereby abandons the fifteen-foot stormwater drainage easement shown on Map 130-04, Parcel 108.00, as described in the plans for Project No. 04-DL-0782, Darren Cioffi, and indicated on Exhibit 1 hereto, which plans and exhibit are incorporated herein, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment.

SECTION 2. That the Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to accept from the respective property owners the easements as described in the plans for Project No. 04-DL-0782, Darren Cioffi, on file with the Department of Water and Sewerage Services, and located on the property described in Exhibit 1 hereto, which plans and exhibit are incorporated herein, and the easements shall be filed in the office of the Register of Deeds to evidence their acceptance.

SECTION 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
