ORDINANCE NO. BL2005-599
An ordinance abandoning a twenty foot Stormwater Drainage Easement, that will be replaced by a fifteen foot Stormwater Drainage Easement as shown on Map 118-06, Parcel 161.00, Project 05-DL-0798, Melrose Shopping Center, Lot 4, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2004M-094U-10).
WHEREAS, a twenty foot Stormwater Drainage Easement, more particularly described in Project No. 05-DL-0798 Melrose Shopping Center, Lot 4, on record in the department of Water and Sewerage Services and incorporated herein by reference, is no longer being used by the Department of Water and Sewerage Services nor any other public utility; and
WHEREAS, a fifteen foot Stormwater Drainage Easement will be replacing the existing twenty foot Stormwater Drainage Easement; and
WHEREAS, The Metropolitan Planning Commission approved this mandatory referral No. 2004M-094U-10 on September 23, 2004 for abandonment of said easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government hereby abandons the twenty foot Stormwater Drainage Easement shown on Map 118-6, Parcel 161.00, Project No. 05-DL-0798 Melrose Shopping Center, Lot 4 as indicated on Exhibit 1 hereto, and the Director of Water and Sewerage Services and the Director of Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.
Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
