ORDINANCE NO. BL2005-598

An ordinance abandoning certain right of way and a utility easement and consolidating certain areas shown on Map 93-2 into a single lot (Proposal No. 2005M-066U-09).

WHEREAS, as shown on the document attached and incorporated into this ordinance as Exhibit A, a portion of the area surrounding the Metropolitan Courthouse is shown as right-of-way (the "Public Square ROW") on the official street and alley map; and

WHEREAS, the Public Square ROW was never formally abandoned but reconfigured prior to 1975 to serve as parking and plaza areas for the Metropolitan Courthouse; and

WHEREAS, as shown on the document attached and incorporated into this ordinance as Exhibit B, between James Robertson Parkway and Union Street there is an unused utility easement (the "Utility Easement"), the abandonment of which will not affect any current utility uses; and

WHEREAS, abandonment of the Public Square ROW and Utility Easement and consolidation of the areas currently comprising the Public Square ROW and lots 56, 108, 186 and 187, Map 93-2, into a single lot will reconcile the public record with actual use of the property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The Public Square Right of Way as shown on Exhibit A is hereby abandoned, and any easements within the Public Square Right of Way likewise are abandoned.

SECTION 2: The utility easement shown on Exhibit B is hereby abandoned.

SECTION 3: The areas comprising the Public Square ROW and lots 56, 108, 186 and 187, Map 93-2, shall be consolidated into a single lot.

SECTION 4: The Director of Public Property Administration is authorized to execute such documents as may be necessary and appropriate to carry out the actions contemplated by this ordinance.

SECTION 5: This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
