ORDINANCE NO. BL2005-636

An Ordinance amending Section 10.20.300 of the Metropolitan Code of Laws regarding dumpster-type containers located within three hundred feet of a residential structure, all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 10.20.300 of the Metropolitan Code shall be and the same is hereby amended as follows:

1. By adding the following new subsection E.3.:

"3. Effective July 1, 2005, all holders of permits for the private collection of garbage owning or maintaining dumpster-type containers shall supply the department of public works with a list of the locations of all of the permit holder's dumpster-type containers that are located within three hundred feet of a building or structure used for residential purposes. Said list shall be updated on a quarterly basis. In that listing of dumpster-type containers, the permit holder shall certify that the private collector is in compliance with subsection E.1. of this Section and that the private collector's dumpster-type containers are compliant with the provisions of subsection E.2. If said list is not provided in accordance with these terms, the director shall revoke the permit issued pursuant to subsection B. of this section.

2. By adding the following new subsection F.:

"F. Should the director determine that a holder of a private collector's permit has not complied with any or all of the provisions of this section, the director may, after written notice to the company or entity, to revoke the permit. If in a given calendar year, the director determines that the permit holder failed to comply with the provisions of this section on three separate instances, the Department shall, after written notice to permit holder, revoke the permit."

3. By adding the following new subsection G.:

"G. Effective July 1, 2005, the department of public works and the department of codes administration shall submit a quarterly report to the metropolitan council listing all documented violations of this section, all citizen complaints of violations of this section, and actions taken by the department(s) to remedy such violations."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
