ORDINANCE NO. BL2005-641

An ordinance authorizing the Mayor to execute Utility Relocation Contract No. 6504 with the State of Tennessee, Department of Transportation, Project No. 19017-2225-04, 19017-4224-04 Slide Repair 9 Mile Hill (LM 9.2).

WHEREAS, the State of Tennessee, Department of Transportation ("TDOT") plans to construct State Project No. 19017-2225-04, 19017-4224-04, Slide Repair 9 Mile Hill (LM 9.2) in Davidson County: and

WHEREAS, Metropolitan Department of Water and Sewerage Services plans to construct the utility work identified as Project No. 19017-2225-04,19017-4224-04 identified in Capital Improvement Budget, No. 96 WG005 and described in the attached Contract: and

WHEREAS, it is in the interest of the Metropolitan Government that this utility work be carried out simultaneously with the State project; and

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 6504 (attached hereto as Exhibit A), the Metropolitan Government will be responsible for one hundred percent (100%) of the actual cost for the utility work, which cost is currently estimated to be $82,072.00;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Utility Relocation Contract No. 6504, attached hereto as Exhibit A and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the Metropolitan Mayor is hereby authorized to execute any supplemental agreements necessary to implement the Local Government Investment Pool Program as pertaining to this Contract, including the agreement attached hereto as Exhibit B.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
