RESOLUTION NO. RS2005-794

A resolution approving the exercise of an option agreement for the purchase of a property located along Mill Creek, for Water and Sewage Services Project No. 02-D-149 (Proposal No. 2002M-112U-11).

Whereas, it is in the public interest for the Metropolitan Government to acquire certain flood-prone properties; and,

Whereas, the property ("Property") listed in Exhibit A as Map 119-07-0, Parcel 36, and shown on Exhibit B is flood prone; and

Whereas, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the Director of Public Property shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council"; and,

Whereas, pursuant to the terms of the document attached as Exhibit C to this resolution, an option permitting the Metropolitan Government to purchase the property has been obtained; and,

Whereas, the Metropolitan Government has received a $1,062,562 federal grant and a $133,967 state grant to fund a substantial part of the purchase of the property; and,

Whereas, the purchase of the property, identified as Water and Sewage Services Project No. 02-D-149, Wimpole Drive Home Buyout, has been funded under Capital Improvements Budget No. 02DG0013 and approved by the Metropolitan Planning Commission on October 24, 2002, Proposal Number 2002M-112U-11 and approved by the Metropolitan Council in Ordinance BL 2002-1164.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the option agreement, attached as Exhibit C, and to execute such documents as may be necessary to effect the purchase of a property located along Mill Creek, for Metro Water and Sewage Services Project No. 02-D-149.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
