RESOLUTION NO. RS2005-768

A resolution requesting the Metropolitan Police Department to enforce the Metropolitan Code of Laws provision prohibiting the collection of garbage within three hundred feet of a residence between the hours of eleven p.m. and seven a.m.

WHEREAS, §10.20.300 of the Metropolitan Code of Laws makes it unlawful for any person to empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of eleven p.m. and seven a.m. when said containers are located within three hundred feet of any structure used for residential purposes; and

WHEREAS, pursuant to §2.44.020 of the Metropolitan Code of Laws, the Metropolitan Police Department is responsible for the enforcement of laws of the state and all ordinances of the Metropolitan Government; and

WHEREAS, residents within Nashville and Davidson County have been told by Metropolitan police officers that the Police Department has no authority to enforce the provisions of §10.20.300 regarding the hours of collection of garbage in residential areas; and

WHEREAS, it is fitting and proper that the Police Department enforce the provisions of §10.20.300 as required by the Metropolitan Code of Laws.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Police Department to enforce the Metropolitan Code of Laws provision prohibiting the collection of garbage within three hundred feet of a residence between the hours of eleven p.m. and seven a.m.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to Chief of Police Ronal Serpas.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
