Metropolitan Council Meeting
Tuesday, February 6, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Jeremy King of Crieve Hall Church of Christ.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of January 16, 2001 were approved.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Nashville Airport Authority

Appointment of Mr. Jim Cheek to the Metropolitan Nashville Airport Authority for a term expiring April 5, 2001. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Convention Center Commission

Appointment of Mr. Robert P. Thomas to the Convention Center Commission for a term expiring June 7, 2001. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Public, Educational and Governmental Access (PEG) Committee

Appointment of Mr. Waverly D. Crenshaw, Jr. to the Public, Educational and Governmental Access (PEG) Committee for a term expiring November 4, 2003. In the absence of the appointee, the confirmation was deferred without objection.

Appointment of Mr. Merritt D. Goetz, Jr. to the Public, Educational and Governmental Access (PEG) Committee for a term expiring November 4, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Ferrell moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmations-Public Elections Committee recommended deferment of the following proposed amendment to the Rules of Procedure of the Metropolitan Council. Mr. Ferrell moved to defer the matter, which motion was seconded and adopted without objection.

Rule 27
By adding the following new provisions at the beginning of the rule:

A resolution appropriating funds from the general fund reserve shall not e placed on the agenda for
consideration, unless previously deferred, except for the second meetings occurring in each month.
Any resolution appropriating funds from the general fund reserve shall be limited to one department
only and shall not contain multiple appropriations.


- RESOLUTIONS-

RESOLUTION NO. RS2000-434

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation that would permit persons convicted of felonies, except murder, rape, treason or voter fraud, to have their full rights of citizenship and right to suffrage restored automatically upon completing service of any sentence imposed. Mr. Wallace offered a substitute resolution and moved that it be accepted for filing, and no objection was made.


SUBSTITUTE RESOLUTION NO. RS2000-434

A substitute resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and adopt legislation that would permit persons convicted of felonies, except murder, rape, treason, voter fraud, or multiple offenders, to have their full rights of citizenship and right to suffrage restored automatically upon completing service of any sentence imposed. RESOLUTION NO. RS2001-480

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and have enacted legislation which would require seat belts on all school buses. The resolution was approved by the Public Safety-Beer, Wine and Whiskey Committee. Ms. Gilmore moved to adopt the resolution, which motion was seconded. After discussion, Mr. Nollner moved for the previous question, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2001-481

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to support the adoption of legislation that would enable local governments to impose real estate transfer taxes. The Budget and Finance Committee recommended deferment of the resolution. Mr. Alexander moved to adopt the resolution, which motion was seconded. Mr. Ferrell moved to defer action indefinitely, which motion was seconded. Mr. Bogen moved to table the motion to defer indefinitely, which motion was seconded and adopted by a roll call vote of the Council. Discussion ensued on the main motion. Mr. Wallace moved for the previous question, which motion was seconded and adopted by a voice vote of the Council. A resolution encouraging the promotion of training for use of automatic external defibrillators and training in cardiopulmonary resuscitation among the citizens of the area of the Metropolitan Government to promote improved cardiac survival rates. A resolution requesting the Davidson County Administrator of Elections and the Davidson County Election Commission to take steps to improve the condition of elections in Davidson County. A resolution requesting the Metropolitan Transit Authority to consider further reducing or eliminating bus fares for senior citizens. A resolution requesting that the Davidson County Delegation to the Tennessee General Assembly introduce and adopt legislation that would require proof of motor vehicle liability insurance before motor vehicles may be registered or have registration renewed by County Clerks. RESOLUTION NO. RS2001-495

A resolution requesting that the Davidson County Delegation to the Tennessee General Assembly introduce and adopt legislation that would require owners of motor vehicles to have a valid Tennessee motor vehicle operators license before motor vehicles may be registered or have registration renewed by County Clerks. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment of the resolution. Mr. Alexander moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-504

A resolution approving an increase in the amount of $620,000 to a grant to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, from the State of Tennessee, Department of Transportation, for the development of the downtown greenway. Mr. Jenkins requested permission to withdraw the resolution, which permission was granted by a unanimous vote of the Council.

RESOLUTION NO. RS2001-505

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of The Metropolitan Government of Nashville and Davidson County against Stantham, L.L.C., and Stanley E. Hillis, and Tony E. Isenberg, c/o Roy J. Dunaway, in the amount of $7,000.00, and directing that this amount be deposited into the Self Insured Liability Account. Mr. Gentry offered a substitute resolution and moved that it be accepted for filing and no objection was made.

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to accept the sum of eighty-eight thousand, seven hundred sixty-three dollars and eighty-four cents ($88,763.84) from the Commonwealth of Kentucky for settlement of a lawsuit brought to recover the expenses incurred by the Metropolitan Government detaining prisoner Edward Rabie while he fought his extradition to Kentucky. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR District to MUN District properties at 409 and 411 Taylor Street, approximately 100 feet east of 5th Avenue North (.14 acres), (Proposal No. 2001Z-004U-08), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2001-593

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 District to CS District property at 106 Dupont Avenue, approximately 155 feet east of North Gallatin Pike (.38 acres), (Proposal No. 2001Z-003U-04), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2001-594

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 and CN Districts to OL District properties at 5601 New York Avenue, 5510 and 5610 California Avenue, and 1605 56th Avenue North, approximately 820 feet west of Centennial Boulevard (2.93 acres), (Proposal No. 2000Z-146U-07), all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.
