ORDINANCE NO. BL2000-569

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new elementary school and a new middle school in the Mt. Pisgah Road area.

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to "…purchase…or otherwise acquire…property…for any public purpose."; and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government "to establish, maintain and regulate…a system of free schools…"; and

WHEREAS, it is in the public interest that certain property be acquired through negotiation or condemnation for the purpose of acquiring land for the construction of two new schools in the Mt. Pisgah Road area.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire, by negotiation or condemnation, property for the purpose of constructing, maintaining and operating two new schools in the Mt. Pisgah Road area.

SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the properties shown on Exhibit A and identified as Parcels 41, 42, 62, 63, 173, 174 and 199 on Tax Map 172.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
