ORDINANCE NO. BL2001-577

An ordinance authorizing conveyance of a temporary easement from The Metropolitan Government of Nashville and Davidson County to the Nashville Electric Service.

Whereas, The Metropolitan Government of Nashville and Davidson County acting through its Department of Public Works, hereinafter "the Metropolitan Government", has recommended replacement of the Shelby Avenue Bridge with the Gateway Boulevard Bridge under the, 23 U.S.C.A., Section 144, Highway Bridge Replacement and Rehabilitation Program; and

Whereas, The State of Tennessee, acting through its Department of Transportation hereinafter referred to as the "State" has allocated funds for the following project, hereinafter "the Project":

BR-STP-345(1), 19958-2792-94; Gateway Boulevard Bridge and approaches over Cumberland River, 19-M3245-1.78; and

Whereas, the State and the Metropolitan Government have agreed to cooperate in constructing the Project, and the Metropolitan Government has agreed to assume ownership and the responsibility to maintain the Project; and

Whereas, the Nashville Electric Service (NES) will be required to relocate certain transmission lines during the term of the Project's construction; and

Whereas, Ordinance No. O93-743 authorized the acceptance of the Project; and

Whereas, it is in the best interest of the Metropolitan Government that NES be granted a temporary easement for the relocation of its existing power lines during construction of the Project.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Public Property Manager of the Metropolitan Government is authorized to execute the attached temporary easement in favor of the Nashville Electric Service.

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
