ORDINANCE NO. BL2000-571

An ordinance approving the transfer to the State of Tennessee of any interests that The Metropolitan Government of Nashville and Davidson County may have in certain real property known as the Hoggatt Family Cemetery.

WHEREAS, The Metropolitan Government of Nashville and Davidson County may have an interest in certain real property known as the Hoggatt Family Cemetery; and

WHEREAS, said cemetery is located totally within the property boundaries of land, known as Clover Bottom, owned by the State of Tennessee (Parcel 19 on Tax Map 85); and

WHEREAS, the State of Tennessee has requested that the Metropolitan Government transfer any and all interests in said property to the State of Tennessee for future maintenance and preservation; and

WHEREAS, the State Building Commission approved a recommendation to accept these property interests by quitclaim deed; and

WHEREAS, the Metropolitan Historical Commission is in agreement with this request and has approved said transfer; and

WHEREAS, the Director of Public Property Administration is authorized to convey property rights, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Metropolitan County Council hereby approves the conveyance of any property rights that the Metropolitan Government may have in property known as the Hoggatt Family Cemetery to the State of Tennessee.

SECTION 2. The Director of Public Property Administration is hereby authorized to convey by quitclaim deed any interests the Metropolitan Government may have in said property and is authorized to execute the necessary documents pertaining thereto

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
