ORDINANCE NO. BL2001-609

An ordinance authorizing Education Network of America to participate with the Metropolitan Government, Department of Water and Sewerage Services, for the construction of Project No. 99-SG-267, McGavock Street between 11th and 12th Avenue South.

WHEREAS, Education Network of America has expressed a desire to provide improved public sewer service to parcel 93-9-233 on McGavock Street between 11th and 12th Avenue South, known as Project No. 99-SG-267; and

WHEREAS, it is deemed to benefit both parties and the general community and Education Network of America is agreeable to paying its proportionate share of the total cost in an amount not to exceed $5,000; and

WHEREAS, this work is identified in Metro's Capital Improvements Budget as Project No. 96-SG-0002.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to accept from Education Network of America an amount not to exceed $5,000 to aid in the construction of sewer improvements for the McGavock Street between 11th and 12th Avenue South project, known as Project No. 99-SG-267.

SECTION 2: Future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
