ORDINANCE NO. BL2000-574

An ordinance approving a Project Cooperation Agreement between the Metropolitan Government and the U.S. Department of the Army, through the Army Corps of Engineers, for stabilization and improvements to the Metro Center Levee and for construction of a greenway on the levee.

Whereas, engineering studies have determined that the Metro Center Levee at the bank of the Cumberland River is in need of stabilization and rebuilding; and,

Whereas, the Metropolitan Government wishes to add a greenway to the Metro Center Levee; and,

Whereas, the Metropolitan Government and the U.S. Department of the Army, through the Army Corps of Engineers, have reached an agreement on a Project Cooperation Agreement whereby the U.S. Army Corps of Engineers will stabilize the streambank, repair and improve the levee, and construct a greenway on the levee; and,

Whereas, the Project Cooperation Agreement calls for the Metropolitan Government to contribute 35% of the funding for the flood control components and 50% of the recreation (greenway) components of the Project; and,

Whereas, the Metropolitan Government's share of the project is estimated to be $2,195,080.00; and,

Whereas, it is in the public interest for the Metro Center Levee Project to proceed.

Now, therefore be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Project Cooperation Agreement, by and between The Metropolitan Government of Nashville and Davidson County and the U.S. Department of the Army, for construction of the Metro Center Levee Project, which Project Cooperation Agreement is attached hereto and made a part of this ordinance, be and the same is hereby approved and the Metropolitan Mayor is authorized to execute the Project Cooperation Agreement on behalf of the Metropolitan Government.

Section 2. That matching funds not to exceed Two Million One Hundred Ninety-Five Thousand and Eighty ($2,195,080.00) Dollars are hereby approved, to be derived from the issuance of general obligation bonds for Project No. 97-PW-019, Metro Center Levee Stabilization.

Section 3. That any amendment to the Project Cooperation Agreement may be approved by resolution of the Metropolitan Council receiving twenty-one (21) votes.

Section 4: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
