ORDINANCE NO. BL2001-612

An ordinance authorizing the Metropolitan Mayor to enter into an agreement with the City of Brentwood to sell the City water in accordance with the terms stated herein.

WHEREAS, the Metropolitan Department of Water and Sewerage Services presently has an agreement to provide water to the City of Brentwood; and

WHEREAS, the City of Brentwood has requested the Metropolitan Government to enter into a new water purchase agreement, and Metro has designed the necessary facility improvements needed in Metro's water system.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute the attached agreement on behalf of The Metropolitan Government of Nashville and Davidson County to sell water to the City of Brentwood, said agreement being hereby adopted by reference as if written verbatim herein, a copy attached.

SECTION 2: Upon passage by the Metropolitan Council and execution by the Metropolitan Mayor, an original agreement shall be assigned an official contract number, and the Metropolitan Clerk shall transmit an original copy of said agreement to the Administrative Officer of the City of Brentwood.

SECTION 3: Future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 4: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
