Metropolitan Council Meeting
Tuesday, June 6, 2006


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Councilman Edward Whitmore.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Williams, Tygard and President Gentry (36); Absent: Crafton (1).

The Minutes of the regular meeting of May 16, 2006, were approved.

Mr. Adkins moved that, at the time of adjournment, the meeting be adjourned to 7:00 p.m. on Tuesday, June 13, 2006, for consideration of Ordinance No. BL2005-1089 on third and final reading, and such other legislation that the Vice Mayor deems appropriate for consideration at that time. The motion was seconded and adopted by a voice vote of the Council.

- MOTION TO RECONSIDER -

BILL NO. BL2006-1011

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning the right-of-way of Alley Number 234 from the intersection of Division Street and Music Circle East around to Music Circle East (Proposal No. 2006M-025U-10) all of which is more particularly described herein. The bill was approved by the Planning Commission; Traffic and Parking Commission; Public Works; Traffic and Parking; and Planning, Zoning and Historical Committees. The vote was called on the motion to reconsider, which motion failed by the following vote: "Ayes" Tucker, Briley, Isabel, Murray, McClendon, Greer, Summers, Foster, Wilhoite, Toler (10); "Noes" Neighbors, Dread, Craddock, Jameson, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Wallace, Walls, Whitmore, Shulman, Adkins, Alexander, Coleman, Tygard (19) "Abstaining" Dozier, Cole, Hart, Williams (4).

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The following proposed amendments to the Rules of Procedure of the Metropolitan Council were deferred to the next meeting:

Rule Nos. 22 and 25:

1. Rule 22 of the 2004-2007 Rules of Procedure of the Council of the Metropolitan Government of Nashville and Davidson County (as amended) shall be and the same is hereby amended by adding the following new paragraph:

"All resolutions accepting donations on behalf of departments, boards, and commissions of the Metropolitan Government shall be automatically deferred one meeting upon being introduced."

2. Rule 25 of the 2004-2007 Rules of Procedure of the Council of the Metropolitan Government of Nashville and Davidson County (as amended) shall be and the same is hereby amended by deleting the last three sentences of the Rule and substituting in lieu thereof the following new sentences:

"Announcements, extraordinary matters, and the presentation of memorializing and congratulatory resolutions shall be held forty-five (45) minutes prior to all regularly scheduled Council meetings. The president pro tempore or his/her designee shall preside over such matters. No presentation of memorializing or congratulatory resolutions shall be conducted during a regularly scheduled meeting of the Council."

- ELECTIONS AND CONFIRMATIONS -

Airport Authority
Reappointment of Mr. Frank M. Garrison for a term expiring June 4, 2010. Without objection, the nomination was deferred to July 6, 2006.

Reappointment of Ms. Juli H. Mosley for a term expiring April 6, 2010. Without objection, the nomination was deferred to July 6, 2006.

Community Access Television Special Committee
Appointment of Ms. Marcie Smeck for a term expiring March 1, 2009. Without objection, the nomination was withdrawn.

Board of Equalization
Appointment of Mr. Will Cheek for a term expiring April 1, 2008, as a General Services District representative. Without objection, the nomination was withdrawn.

Appointment of Mr. Mark Deutschmann for a term expiring April 1, 2008, as an Urban Services District representative. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Gas/Mechanical Examiners and Appeals Board
Appointment of Mr. T. J. McDaniel for a term expiring January 30, 2010. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Mr. Carter Andrews for a term expiring April 18, 2007. Without objection, the nomination was withdrawn.

Reappointment of Ms. Nonye Ejiofor for a term expiring April 18, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Plumbing Examiners and Appeals Board
Appointment of Mr. James Hodge for a term expiring March 10, 2010. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Stormwater Management Committee
Appointment of Ms. Emily Carr for a term expiring July 8, 2009. Without objection, the nomination was deferred to July 6, 2006.

- BILL ON PUBLIC HEARING -

BILL NO. BL2006-1089

An ordinance adopting the Capital Improvements Budget and Program 2006-2007 through 2011-2012 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2006-2007. The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees. Ms. McClendon requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Ms. McClendon moved to pass the bill on second reading and re-refer the bill to the Budget and Finance and Planning, Zoning and Historical Committees, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1317

A resolution authorizing West End Restaurants to install, construct and maintain a metal canopy extending three feet from the building envelope beyond the property line and ten feet above the sidewalk along West End Avenue (Proposal No. 2006M-056U-10). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. RESOLUTION NO. RS2006-1318

A resolution authorizing Stahlman Redevelopment Partners to install, construct and maintain an aerial encroachment of 5 foot x 8 foot flags at a 33 degree angle, 22 feet above sidewalk on 3rd Avenue North and on Union Street (Proposal No. 2006M-055U-09). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. RESOLUTION NO. RS2006-1328

A resolution appropriating to certain accounts for the benefit of the Metropolitan Public Health, Transportation Licensing Commission, and District Attorney in the amount of Two Million, One Hundred Ninety-Four Thousand, Five Hundred Dollars ($2,194,500) from designated and undesignated fund balances of the general fund of the General Services District, increased revenue sources and from other sources. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee; the Budget and Finance and Health, Hospitals and Social Services Committees recommended deferment. Ms. McClendon moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1329

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount not to exceed Two Hundred Ninety-Six Million Three Hundred Twenty-Five Thousand Three Hundred Thirty-Two Dollars ($296,325,332) to be financed by the ad valorem levy on property in the General Services District and in an aggregate principal amount of Twenty-Two Million Three Hundred Fifty-Six Thousand One Hundred Fifty Dollars ($22,356,150) to be financed by the ad valorem levy on property in the Urban Services District. The Budget and Finance Committee recommended deferment. Ms. McClendon moved to defer the resolution to the second meeting in July, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1330

A resolution supplementing and amending Resolution No. RS2006-1305 of The Metropolitan Government of Nashville and Davidson County and awarding the sale of the Metropolitan Government's General Obligation Bonds, Series 2006B.

The Clerk reported that the following bids were received on this date for the sale of General Obligation Bonds of The Metropolitan Government of Nashville and Davidson County, Series 2006B, in the amount of $203,780,000:

The report of the bids received for sale of The Metropolitan Government of Nashville and Davidson County's $203,780,000 General Obligation Bonds, Series 2006B, recommended acceptance of the bid of Morgan Keegan & Company, Inc. at a true interest cost of 4.378445 %.

Ms. McClendon offered a substitute resolution and moved that it be accepted for filing, and no objection was made.

SUBSTITUTE RESOLUTION NO. RS2006-1330

A substitute resolution supplementing and amending Resolution No. RS2006-1305 of The Metropolitan Government of Nashville and Davidson County and awarding the sale of the Metropolitan Government's General Obligation Bonds, Series 2006B. The substitute resolution was approved by the Budget and Finance Committee. A resolution electing to sell the tax receivables of The Metropolitan Government of Nashville and Davidson County, Tennessee. The Budget and Finance Committee recommended deferment. Ms. McClendon moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1332

A resolution adopting a fee schedule associated with the processing and review of certain zoning-related applications (Proposal Number 2006Z-094T). The resolution was approved by the Planning Commission and Planning, Zoning and Historical Committee; the Budget and Finance Committee recommended deferment with an amendment. Ms. McClendon offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. McClendon moved to defer the resolution as amended, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1333

A resolution providing additional compensation to the Davidson County Circuit Court Clerk and the Davidson County Criminal Court Clerk in an amount equal to ten percent (10%) of their base compensation, pursuant to T.C.A. § 8-24-102(j)(2). The Budget and Finance Committee recommended deferment. Ms. McClendon moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1334

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The Charter Revision Committee recommended indefinite deferment. Mr. Foster moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2006-1335

A resolution approving a contract for services by and between the Metropolitan Government by and through the Board of Health and the Campus for Human Development for the operation of an educational day center and housing for substance abuse treatment participants. An ordinance establishing the tax levy in the General Services District for the fiscal year 2006-2007, and declaring the amount required for the annual operating budget of the Urban Services District, pursuant to Section 6.07 of the Metropolitan Charter. BILL NO. BL2006-1093

An ordinance to amend Ordinance No. BL2001-777 by partially repealing the waiver of fees for processing credit or debit card payments when collecting funds on behalf of the Metropolitan Government. BILL NO. BL2006-1094

An ordinance increasing the Police Department Impound Lot (tow-in lot) storage fees, and amending Sections 6.80.550 and 12.72.040 of the Metropolitan Code of Laws. BILL NO. BL2006-1095

An ordinance amending Title 15 of the Metropolitan Code of Laws by repealing Section 15.32.040 relating to the rate charged for water furnished to one customer through multiple meters; by adding a new Section 15.20.045 imposing a water system capacity charge in the amount of $1000 per single family equivalent connection; by amending Section 15.36.040 to change the existing sewer system capacity charge from $500 to $2000 per single family equivalent connection; and by amending Section 15.48.090 to permit quarterly meter reading. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2006-1096

An ordinance amending Chapter 3.08 of the Metropolitan Code of Laws to require the Metropolitan Benefit Board to provide an annual report to the Council regarding the Metropolitan Government pension system. BILL NO. BL2006-1097

An ordinance amending Article I of Chapter 6.20 of the Metropolitan Code of Laws to require that apprentice electricians doing business within the area of the Metropolitan Government be licensed, to add additional provisions regarding apprenticeship programs, and to add penalty provisions and additional grounds for violations. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2006-1098

An ordinance amending Section 7.08.040 of the Metropolitan Code of Laws to prohibit persons convicted of driving under the influence (DUI) from obtaining a permit for the sale, distribution, manufacturing or storage of beer from the Metropolitan Beer Permit Board. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

An ordinance approving an agreement between the Metropolitan Government and the State of Tennessee, Department of Finance and Administration, relating to the installation of certain safety equipment for the District Energy System. An ordinance authorizing the Metropolitan Government to participate with Burkitt Place Development LLC, to provide public sewer service in Davidson and Williamson County to Burkitt Place Phase 1-A, Section 1, Project No. 05-SL-114A. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2006-1102

An ordinance authorizing the Metropolitan Government to participate with Centex Homes to provide public sewer service in Davidson County to Villas of Concord Place, Phase 5, Project No. 05-SL-47D. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees.

BILL NO. BL2006-1103

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by changing the name of 20th Avenue North between Charlotte Avenue and the dead end north of Warner Street to "Spruce Street" (Proposal No 2006M-068U-08). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Emergency Communications District Board, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2006-1104

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to RS20 zoning on a portion of the property at 1811 Woodmont Boulevard (0.46 acres), and from R40 to RS40 on property at Woodmont Boulevard (unnumbered) and a portion of property at 1811 Woodmont Boulevard (1.17 acres), near the southwest corner of Woodmont Boulevard and Stokesmont Road, all of which is described herein (Proposal No. 2006Z-052U-10). The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2006-1105

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to AR2a zoning properties located east of Blake Drive between Blake Drive and Mill Creek (7.19 acres), all of which is described herein (Proposal No. 2006Z-076G-12).
The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2006-1106

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM9 to OR40 district property located at Cheron Road (unnumbered), approximately 575 feet west of Briarville Road (5.33 acres), all of which is described herein (Proposal No. 2006Z-037G-04). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2006-1107
