An ordinance approving an agreement between the Metropolitan Government and the State of Tennessee, Department of Finance and Administration, relating to the installation of certain safety equipment for the District Energy System.

Whereas, the Metropolitan Government owns and operates a district energy system ("DES"), which provides heating and cooling services to certain buildings in downtown Nashville; and

Whereas, the State of Tennessee owns certain buildings that obtain heating and cooling services from the DES by way of equipment and lines in tunnels on property also belonging to the State of Tennessee; and

Whereas, installation of certain communication equipment (the "Equipment") will enhance the safety of personnel working in the tunnels; and

Whereas, pursuant to the agreement (the "Agreement") attached to this ordinance as Exhibit 1, the parties have agreed to share the costs of installing the Equipment.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Agreement (Exhibit 1) between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Finance and Administration, is hereby approved, and the Director of Finance is authorized to execute the Agreement on behalf of the Metropolitan Government.

Section 2. That any amendments to the Agreement shall be approved by Resolution of Council.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
