RESOLUTION NO. RS2006-1340

A resolution authorizing the Department of Law to pay $250,000.00 into the court as the full amount allowed under the Tennessee Governmental Tort Liability Act for the claims of Terrie H. Fish against The Metropolitan Government, and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on August 8, 2005, Metropolitan Police Officer Bruce Landes was traveling westbound on Charlotte Pike when he crossed the centerline into oncoming traffic striking the vehicle driven by Terrie H. Fish in a head-on collision, and Ms. Fish suffered multiple injuries as a result of the collision; and

Whereas, Terrie H. Fish brought suit againstsued the Metropolitan Government of Nashville Davidson County in Circuit Court for personal injuries and property damage; and

Whereas, after investigation, the Department of Law believes that the Metropolitan Government will be held liable for $250,000.00, which is the full amount allowed under the Tennessee Governmental Tort Liability Act, that it is in the best interest of the Metropolitan Government that this amount be paid into court to dismiss this lawsuit, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to pay the amount of $250,000.00 into the court as the Metropolitan Government's total statutory liability in the lawsuit lawsuit of Terrie H. Fish, which . Said amount shall be paid from the Self-Insured Liability Fund.

Section 2. This Resolution shall take effect from and after it's adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
