RESOLUTION NO. RS2006-1352

A resolution requesting the Mayor, the Department of Public Works, the Board of Parks and Recreation, and the U.S. Army Corps of Engineers to examine the feasibility of using federal and/or local funding to stabilize the structure supporting the electrical tower located behind the Justice A.A. Birch Building along the Cumberland River downtown greenway.

WHEREAS, a tower for high voltage power lines is currently supported by an old building on the west bank of the Cumberland River along the greenway below the Justice A.A. Birch Criminal Courts Building; and

WHEREAS, the structure supporting this tower is in serious need of repair and stabilization; and

WHEREAS, if this structure is not stabilized, the building could potentially collapse causing the tower to fall off into the Cumberland River or onto the greenway; and

WHEREAS, in order to avoid serious problems in the future, and to protect the safety of the citizens of Nashville, it is fitting and proper that the U.S. Army Corps of Engineers and the Metropolitan Government take the action necessary to stabilize the structure located on the bank of the Cumberland River supporting an electrical tower.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor, the Department of Public Works, the Board of Parks and Recreation, and the U.S. Army Corps of Engineers to examine the feasibility of using federal and/or local funding to stabilize the structure supporting the electrical tower located behind the Justice A.A. Birch Building along the Cumberland River downtown greenway.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution to Mayor Bill Purcell, to Billy Lynch, the Director of the Department of Public Works, to Roy Wilson, the Director of Parks, and to the U.S. Army Corps of Engineers.

Section 3. The Mayor, the Department of Public Works, and the Board of Parks and Recreation are further requested to respond to the Council as to the action taken in compliance with the request stated in Section 1 hereof not later than sixty (60) days after the adoption of this Resolution.

Section 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
