Metropolitan Council Meeting

Tuesday, December 1, 1998


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Eugene Waddell.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Varallo, Armistead, Steine, Ferrell, Waters, Patton, Black, Nollner, Majors, Harrison, Beehan, Campbell, Hart, Dillard, Garrett, Wooden, Ponder, French, Dale, Graves, Douglas, Clifton, Sloss, Haddox, McCallister, Crafton, Johns, Kleinfelter, Arriola, Sontany, Hall, Holloway, Hollis, Alexander, Jenkins, Turner, Fentress, Lineweaver, and President West (39); Absent: Stanley (1).

The Minutes of the regular meeting of November 17, 1998 were approved.

The President gave notice of one vacancy on the Industrial Development Board of the Metropolitan Government and announced that nominations would be taken at the next regular meeting of the Council for a term ending August 23, 2001, pursuant to Rule 42 of the Rules of Procedure of the Metropolitan Council. Nominees will be referred to the Rules-Confirmations-Public Elections-Aviation Committee for a recommendation and an election will be held by the Council at its first meeting in January.

The President gave notice of three vacancies on the Health and Educational Facilities Board of the Metropolitan Government and that nominations will be taken at the next regular meeting of the Council for a term ending September 30, 2004, pursuant to Rule 42 of the Rules of Procedure of the Metropolitan Council. Nominees will be referred to the Rules-Confirmations-Public Elections-Aviation Committee for a recommendation and an election will be held by the Council at its first meeting in January.

The President gave notice that an election will be held by the Council at its first meeting in January to elect two of its members to serve on the Council's Audit Committee.

Re: Veto of Ordinance O97-919-Acceptance of Dedication of Heath Road

Dear Vice Mayor West and Members of the Council:

I am returning to you Ordinance 097-919 marked "VETO." The reasons for this action are as follow:

  1. The Council, within the past few months, set standards for the acceptance of private roads (Ordinance 098-1120). This bill set a series of reasonable standards for the acceptance of private roads that did not measure up to full public road standards, and established some carefully considered middle ground between the desires of property owners along private roads and the general public.
  2. Heath Road does not meet the standards set forth in that ordinance. In particular:

            i.     The standards require a minimum roadway width of 22 feet, and Heath Road varies between 18 and 22 feet wide.

           ii.    The side slopes on Health Road exceed the ratio of 3 to 1, set forth in the "Policy on Geometric Design of
                 Highways and Streets." It therefore does not have the required shoulders nor does it have a guardrail to protect
                 vehicles that leave the pavement. This is further complicated by its narrow width.

            iii.  The standards call for a design speed of 20 mph. Heath Road has two curves that are constructed for 15 mph or
                 less.

            iv.     There is a requirement for a drainage system to handle a 10-year storm. At lease one location on Heath Road
                    would require the addition of a culvert to achieve that.

 

    3.  I asked Marlin Keel for an informal estimate on the cost to bring Heath Road to the minimum standards for acceptance
          by the city, and he has estimated $175,000. Accordingly, if either the road is brought to the current minimum standards,
         or if the property owners were to put up $175,000 for the city to perform that work, I would be more than happy to
        support the acceptance of Heath Road. Failing that, I believe it’s incumbent on all of us to honor the standards that were
        set six months ago by the Council.

- RESOLUTIONS -

RESOLUTION NO. R98-1341

A resolution to approve an amendment to the Professional Services Agreement between The Metropolitan Government of Nashville and Davidson County and Forensic Medical Management Services agreeing to terms under which Forensic Medical Management Services will perform non-Davidson County autopsies. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees with an amendment. Mr. Haddox offered Amendment No. 1 and moved for its adoption which motion was seconded. Mr. Majors moved to disapprove Amendment No. 1 which motion was seconded and adopted by a voice vote of the Council. Mr. Turner offered Amendment No. 2 which motion was seconded. After discussion, Mr. Lineweaver moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R98-1350

A resolution to appropriate funds for the fiscal year 1998-1999 from the Recycling Rebate Grant to support the Metropolitan Government Drop-off Recycling Program; and to appropriate funds for use by the Solid Waste Division of the Department of Public Works. The resolution was approved by the Budget and Finance Committee; the Public Works Committee recommended deferment of the resolution. Mr. Majors moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. R98-1356

A resolution requesting the Davidson County Delegation to the 101st Session of the General Assembly to adopt legislation to amend State law to provide that graffiti visible from public rights-of-way constitutes a public nuisance and to authorize local governments to clean graffiti from private properties that are next to and visible from public rights-of-way. The resolution was approved by the Rules-Confirmations-Public Elections-Aviation Committee. A resolution approving a grant of $75,000 from the Tennessee Housing Development Agency to The Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Development and Housing Agency for participation in the Disaster Housing Recovery Program. The resolution was approved by the Federal Grants Review Committee. BILL NO. O98-1474

An ordinance to amend Section 6.12.060 of the Metro Code of Laws to amend the hours of operation which a business may operate a public dance or public dancehall to be consistent with the hours of operation during which beer may be sold and consumed on premises having a valid beer permit and to amend Section 6.12.070 for consistency with Section 7.08.170.
