ORDINANCE NO. O98-1435

 An ordinance approving a lease agreement between the Metropolitan Government and the State of Tennessee for lease of premises on Griffith Road as a site for the construction and maintenance of an 800MHz emergency communications tower.

WHEREAS, the Metropolitan Government and NES are in the process of developing a greatly improved and new emergency communications system using new digital radio technology at a frequency of 800MHz; and

WHEREAS, the construction of new radio communications towers at high elevations in Davidson County is a necessary component of the new emergency communications system; and,

WHEREAS, one of the radio communications towers is planned to be located on a site on Griffith Road in Davidson County; and

WHEREAS, the owner of that site, the State of Tennessee and the Metropolitan Government have concluded negotiation on the terms of a 25-year lease of sufficient real estate and access thereto for the construction and operation of a radio communications tower, and to allow use of the tower by the Tennessee Emergency Management Agency (TEMA)..

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee for lease of premises and access thereto on Griffith Road, as further described in the Lease Agreement and attachments thereto, made a part of this ordinance, for use as a site for an 800 MHz radio communications tower for a term of twenty-five (25) years, at no cost in consideration of use by TEMA, be, and the same is, hereby approved.

Section 2. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
