ORDINANCE NO. O98-1449

An ordinance approving a lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Health, with Rock City Realty Company, Inc., for certain real property to be used as a facility for distribution of food products through the Metropolitan Board of Health Commodity Supplemental Food Program.

WHEREAS, the Metropolitan Government and Rock City Realty Company, Inc. are parties to a lease agreement for certain real property that is used for the Metropolitan Board of Health Commodity Supplemental Food Program; and

WHEREAS, the present lease agreement for the Metropolitan Board of Health Commodity Supplemental Food Program is set to expire on or about December 31, 1998; and

WHEREAS, the parties desire to enter into a new lease agreement that will allow the Metropolitan Government to remain in possession and continue the Metropolitan Board of Health Commodity Supplemental Food Program beyond the term of the lease that will expire on or about December 31, 1998.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Health, for the lease of premises to be used for the Metropolitan Board of Health Commodity Supplemental Food Program, as further described in the lease agreement and attachments thereto, made a part of this ordinance, is hereby approved.

Section 2. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. O98-1449

Mr. President:

I hereby move to amend ORDINANCE NO. O98-1449 by deleting pages 8 and 9 of the Lease Agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the and through the Metropolitan Department of Health, with Rock City Realty Company, Inc., and replacing the same with revised pages 8 and 9, which are attached hereto.
