The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Pastor Shane England of Resonate Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Please find attached the State of Tennessee reporting forms required to be submitted to the local legislative body following the sale of bonds previously authorized by the Metropolitan Council. These reports are for the sale of $347,235,000 of General Obligation Improvement Bonds, Series 2015C which closed on July 30, 2015. The true interest cost on the bonds is 3.17%.

As always, we appreciate the Metropolitan Council’s support on these important financing initiatives.

Agricultural Extension Board
Reappointment of Mr. Bobby Edwards for a term expiring August 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Appointment of Mr. Pat Cummins for a term expiring August 1, 2019. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Mark Rogers for a term expiring August 1, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2015-1585

A resolution exempting Zoe’s Kitchen at 6025 Highway 100 from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Todd requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. SUBSTITUTE BILL NO. BL2015-1207

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to SP zoning for properties located at 7037 Highway 70 S and Highway 70 S (unnumbered), east of Old Hickory Boulevard (3.17 acres), to permit a commercial/office development, all of which is described herein (Proposal No. 2015SP-043-001). The bill was approved by the Planning Commission with conditions, disapproved without.

BILL NO. BL2015-1253

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, to modify the maximum height for transitional properties in the Lafayette subdistrict within Chapter 17.37, all of which is described herein (Proposal No. 2015Z-013TX-001). The bill was approved by the Planning Commission with an amendment. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1254

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, designating “mineral extraction” as a use permitted with conditions in the IG zoning district and adding conditions applicable to this use, all of which is more particularly described herein (Proposal No. 2015Z-016TX-001). Mr. Hagar moved to suspend the rules to allow the bill to be heard and objections were made. Mr. Hagar moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1255

An ordinance to add Section 17.12.120 of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, to permit the transfer of development rights from historic properties in Metropolitan Nashville as "sending" sites to designated "receiving" sites, which is more particularly described herein (Proposal No 2015Z-015TX-001). Ms. Allen moved to suspend the rules to allow the bill to be heard and no objections were made. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Allen moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1261

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to SP zoning for a portion of property located at 210 South 10th Street, at the southwest corner of South 10th Street and Russell Street (0.57 acres), to permit up to 8 residential units, all of which is described herein (Proposal No. 2015SP-070-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Westerholm requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2015-1264

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL and AR2a to CS for property located at 1827 Murfreesboro Pike, approximately 115 feet west of Harding Place (1.47 acres), all of which is described herein (Proposal No. 2015Z-067PR-001). The bill was disapproved by the Planning Commission.

BILL NO. BL2015-1265

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling the existing Canter Chase PUD for part of the property located at 1827 Murfreesboro Pike, approximately 115 feet west of Harding Place (0.94 acres), all of which is described herein (Proposal No. 239-84P-003). The bill was disapproved by the Planning Commission.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Seven Springs Planned Unit Development Overlay for property located 310 Seven Springs Way, south of Old Hickory Boulevard (12 acres) zoned OR40, to permit changes to the height limitations and the landscape buffer yard requirements, all of which is described herein (Proposal No. 98P-007-009). Mr. Banks moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1267

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Historic Landmark Overlay District to a portion of property located at 3606 West End Avenue, at the northeast corner of Craighead Avenue and West End Avenue (0.46 acres), zoned RM40, all of which is described herein (Proposal No. 2015HL-015-001). The bill was approved by the Planning Commission. Mr. Holleman requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2015-1297

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to SP zoning for property located at 1000 Old Dry Creek Road, approximately 620 feet west of Gallatin Pike (4.06 acres), to permit a building contractor supply use, all of which is described herein (Proposal No. 2015SP-057-001). The bill was disapproved by the Planning Commission. Mr. Pardue requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Pardue moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

Mr. Scott Davis requested a suspension of the rules to allow the bill to be heard and no objection was made. Mr. Davis requested a hearing from the public on this bill which had been previously advertised. An ordinance amending Section 7.08.090 of the Metropolitan Code to provide a mechanism for retail establishments to obtain an exemption from the minimum distance requirements for obtaining a beer permit upon approval of the Metropolitan Council by resolution, to remove the requirement that a restaurant possess a license issued by the state alcoholic beverage commission for sale and consumption of wine or other alcoholic beverages on the premises in order to obtain an exemption to the minimum distance requirements, and to add a requirement that a sign be posted advertising the public hearing.
