RESOLUTION NO. RS2015-1594

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Hart Lane Pedestrian Safety Improvements, PIN 119913.01.

WHEREAS, The Metropolitan Government of Nashville and Davidson County (“Metro”) and the State of Tennessee, Department of Transportation (“TDOT”) seek to enter into an intergovernmental agreement for Hart Lane Pedestrian Safety Improvements, including remediation of rock cut slope for re- construction of sidewalks along Hart Lane from Jere Baxter Middle School to Ellington Parkway with improvements to signage, a crosswalk and utility relocation, PIN 119913.00; and,

WHEREAS, RS2014-1311 approved an application for a grant from TDOT to Metro for Hart Lane Pedestrian Safety Improvements; and

WHEREAS, pursuant to the agreement Metropolitan Government is responsible for the PE-NEPA, PE-Design, ROW Acquisition, and Utility Coordination phases; and

WHEREAS, the construction phase, with an estimated cost of $1,874,974.25, is shared 80% federal for a total of $1,499,979.40 and 20% Metro for a total of $374,994.85; and

WHEREAS, pursuant to the agreement the Metropolitan Government is responsible for the construction phase including the CEI; and

WHEREAS, the agreements notice to proceed date with construction is November 1, 2018 with a completion date of November 1, 2020; and

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Hart Lane Pedestrian Improvements, PIN 119913.01, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this agreement to be paid by the Metropolitan Government be appropriated to the Department of Public Works based on the revenues estimated to be received.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
