ORDINANCE NO. BL2015-1292

An ordinance approving an Agreement by and between the Metropolitan Government, acting by and through its Department of Public Works, and CSX Transportation, Inc. for the construction of a new overhead highway bridge to carry the proposed extension of Division Street over the CSXT tracks and right-of-way at Railroad Milepost 000-187.12 and the closure of Fogg Street / 7th Avenue South at–grade crossing (AAR DOT#350200Y) Nashville, TN.

WHEREAS, CSX Transportation, Inc. is willing to cooperate with the Metropolitan Government regarding the construction of a new overhead highway bridge to carry the proposed extension of Division Street over the CSXT tracks and right-of-way at Railroad Milepost 000-187.12 and the closure of Fogg St / 7th Avenue South at-grade crossing ( AAR DOT# 350 200Y ) Nashville, TN, pursuant to the terms of the agreement attached hereto (“Agreement” ); and,

WHEREAS, the CSXT cost force account estimate for engineering and inspection phase, flagging services, and signal and communication work is $406,025.00; and,

WHEREAS, it is the purpose of said Agreement to provide for the terms and conditions upon which construction of the Project shall proceed and the parties' obligations with respect to the future maintenance and operation of the permanent aspects of the Project.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section1. That the Agreement for the construction of a new overhead highway bridge to carry the proposed extension of Division Street over the CSXT tracks and right-of-way at Railroad Milepost 000-187.12 and the closure of Fogg Street / 7th Avenue South at–grade crossing (AAR DOT#350200Y) Nashville, TN, attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this enactment shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
