ORDINANCE NO. BL2015-1276

An ordinance amending Title 2 of the Metropolitan Code and authorizing the Mayor to enter into Consortium Agreements pursuant to the Workforce Innovation and Opportunity Act of 2014.

WHEREAS, the Nashville Career Advancement Center was created through the enactment of ORDINANCE NO. BL2001-697 and pursuant to the authority provided in the Workforce Investment Act of 1998; and,

WHEREAS, Congress has now replaced the Workforce Investment Act of 1998, through the enactment of the Workforce Innovation and Opportunity Act of 2014 (29 U.S.C. § 2801, et seq.); and,

WHEREAS, the Workforce Innovation and Opportunity Act of 2014 (hereinafter “the Act of 2014”) establishes a framework for governors of the states to establish Local Workforce Innovation and Opportunity Areas and certify local workforce innovation and opportunity boards to expedite the delivery of services funded under the Act of 2014 on a regional basis; and,

WHEREAS, under authority of the Act of 2014, the Governor of Tennessee has designated the Local Workforce Innovation and Opportunity Area Nine consisting of Davidson, Rutherford, Trousdale, and Wilson counties in the state of Tennessee (the counties), and a Local Workforce Innovation and Opportunity Board comprised of representatives from such counties is to be established as a regional entity responsible for the implementation and operation of the work force development system; and,

WHEREAS representatives of Local Workforce Innovation and Opportunity Area Nine have executed a new Consortium Agreement to effectuate the designation and memorialize the agreement of the parties; and,

WHEREAS, Nashville Career Advancement Center, a division of the Mayor’s Office within Metropolitan Government, is to be the local fiscal agent and administrator of the Act of 2014 funds under the Board's jurisdiction; and,

WHEREAS, there is a need to formally establish the Nashville Career Advancement Center (NCAC) as operating pursuant to the authority under the Act of 2014, similarly to the role of NCAC in past years under the Workforce Investment Act of 1998; and,

WHEREAS, it is important that the Mayor have the authority to enter into, authorize, and execute agreements as required under the Workforce Innovation and Opportunity Act of 2014 or any amendments to the Act as passed by Congress;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 2 of the Metropolitan Code be amended by deleting the reference to the “Workforce Investment Act of 1998” and replacing it with the “Workforce and Innovation Opportunity Act of 2014” where such reference appears within MCL § 2.175.010, such that it reads:

“Coordination among government departments, agencies and officials as necessary to meet the objectives of the NCAC and the other administrative entities created by the State of Tennessee under the Workforce Innovation and Opportunity Act of 2014. (Federal Act).”

Section 2. That the Consortium Agreement for the area designated by the Governor of Tennessee as of Local Workforce Innovation and Opportunity Area Nine attached to this legislation is hereby approved and that the Mayor shall have the authority to enter into, authorize, and execute agreements as required under the Workforce Innovation and Opportunity Act of 2014 or any subsequent amendments to the Act as passed by Congress.

Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
