ORDINANCE NO. BL2015-1283

An ordinance approving an agreement between The Metropolitan Government of Nashville and Davidson County and Vision Real Estate Investment Corporation for the sale of real property located at 1010 Camilla Caldwell Lane. (Proposal No. 2014M-002PR-002).

WHEREAS, pursuant to Ordinance No. BL2014-688, the Metropolitan Government agreed to sell approximately 76 acres to Vision Real Estate Investment Corporation (“Vision”) located at 1010 Camillia Caldwell Lane; and

WHEREAS, pursuant to that agreement, the sale was conditioned on the passage of certain state legislation related to the bed licenses at Bordeaux Long Term Care; and

WHEREAS, that condition was not met because the state legislation was not passed by the General Assembly; and

WHEREAS, Vision and the Metropolitan Government have agreed to a revised land sale agreement which still allows for the property to be used for the development of affordable housing designed for seniors, but removes the land surrounding the Bordeaux Long Term Care facility; and

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the agreement described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Purchase and Sale Agreement by and between Vision Real Estate Investment Corporation and the Metropolitan Government of Nashville and Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor or his designee is authorized to execute the same.

Section 2. Amendments to this agreement may be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. The Metropolitan Mayor or his designee is authorized to execute such documents as are necessary to effectuate the property conveyance contemplated herein.

Section 4. This ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
