ORDINANCE NO. BL2015-1307

An ordinance approving an agreement with and easement for Sprint Communications Company L.P. relating to construction of a pedestrian tunnel by the Metropolitan Department of Parks and Recreation. (Proposal Number 2015M-025PR-001).

WHEREAS, the Metropolitan Government plans to undertake a project (the “Project”) involving the construction of a pedestrian tunnel under a section of railroad near Highway 100 and Warner Park; and,

WHEREAS, the Project requires the relocation of a telecommunications cable belonging to Sprint Communications Company L.P. (“Sprint”); and,

WHEREAS, pursuant to the terms of the agreement (“Agreement”) attached as Exhibit A to this ordinance, Sprint proposes to relocate the cable to accommodate the Project in exchange for the Metropolitan Government’s payment of one-half the cost of the relocation, not to exceed $150,000 and conveyance of an easement (the “Easement”) for other Sprint cables currently located in railroad rights of way adjacent to Metropolitan Government property; and,

WHEREAS, approval of the Agreement is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Agreement and Easement are approved, and the Director of Public Property or his designee is authorized to execute them on behalf of the Metropolitan Government.

Section 2. The Director of Public Property or his designee is further authorized to execute such documents as are customary and necessary to effect the purposes of this ordinance.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
