ORDINANCE NO. BL2015-1212

An Ordinance amending Section 7.08.140 of the Metropolitan Code to prohibit the sale of single cans or bottles of beer by off-sale permit holders located within 100 feet of a facility that provides food to homeless persons.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 7.08.140 of the Metropolitan Code is hereby amended by adding the following new subsection U.:

“U. For off-sale permit holders to sell beer and malt beverages in single cans or bottles if the property line of the business is within one hundred (100) feet of the property line of a facility that makes food available to homeless persons more than once per week. Notwithstanding the foregoing, a permit holder shall be exempt from the distance requirement set forth in this subsection upon the adoption of a resolution by the metropolitan council receiving twenty-one affirmative votes approving the exemption of the premises for which the permit is issued from said minimum distance requirement.”

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
