ORDINANCE NO. BL2015-1290

An ordinance authorizing the acquisition and conveyance to the Tennessee Department of Transportation a certain right of way, drainage easements, temporary construction easements, and property rights by negotiation or condemnation for Metro Water and Sewer Services and Metro Public Works Departments on SR 1, Murfreesboro Pike Drainage Improvements, including the Vultee Boulevard Bridge Removal and the Kermit Drive Intersection, Project Number PIN 121040.00 (Proposal No. 2015M-029ES-001).

WHEREAS, it is in the public interest that right of way, drainage easements, temporary construction easements and property rights be acquired by the Metropolitan Government, for use in public projects of the Metropolitan Government, initially for purposes of Metro Water and Sewer Services and Public Works Departments Project No. 121040.00, Proposal No.2015M-029ES-001, SR1, Murfreesboro Pike Drainage Improvements, including the the Vultee Boulevard Bridge removal and the Kermit Drive Intersection; and,

WHEREAS, the right of way, drainage easements, temporary construction easements, and property rights are located on the property described in Exhibit 1 hereto; and,

WHEREAS, RS2014-1248, approved an agreement with Metro Water and Sewer Services and Metro Public Works Department and the Tennessee Department of Transportation for the SR1, Murfreesboro Pike drainage improvements PIN 121040.00; and

WHEREAS, Metro agrees to follow the uniform act for acquisitions and condemnations of any right of way, drainage easements, construction easements, and property rights for SR1, Murfreesboro Pike PIN 121040.00, Proposal No. 2015M-029ES-001; and

WHEREAS, Metro further agrees to convey to Tennessee Department of Transportation said right of way, drainage easements, temporary construction easements, and property rights acquired for purposes of SR1, Murfreesboro Pike drainage construction phase PIN 121040.00, Proposal No. 2015M-029ES-001; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County, by and through the Director of Public Property Administration, is hereby authorized to acquire by negotiation or condemnation the following described easements for the Metropolitan Government, initially for purposes of Metro Water and Sewer Services and Public Works Department PIN 121040.00, Proposal No. 2015M-029ES-001, SR1, Murfreesboro Pike Drainage, including Vultee Boulevard Bridge Removal and Kermit Drive Intersection, the same being for a public purpose and the public convenience requiring it.

Section 2. The easements and property rights to be acquired are described in the Metropolitan Water and Sewer Service’s and Public Works Department’s plans on file for PIN 121040.00, Proposal No. 2015M-029ES-001, SR1, Murfreesboro Pike Drainage and located on the property described in Exhibit 1 hereto, which plans and Exhibit are incorporated herein.

Section 3. The Director of Public Property Administration is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the interests in real property described herein in the name of The Metropolitan Government of Nashville and Davidson County for use in public projects of the Metropolitan Government.

Section 4. The Director of Public Property is hereby authorized to convey to the Tennessee Department of Transportation said right of way, permanent drainage easements, construction easements, and property rights acquired for project PIN 121040.00.

Section 5. All necessary and incidental costs of the right of way easements and property rights herein authorized to be acquired shall be paid from funds authorized from Metro Water and Sewer Services Fund No. 41113 and Business Unit No. BU65411113, Metro Public Works Fund No. 40015 and Business Unit No. 42404015.

Section 6. This ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
