ORDINANCE NO. BL2015-1291

An ordinance approving an Agreement by and between the Metropolitan Government, acting by and through its Department of Public Works, and CSX Transportation, Inc. for the painting and repairs of an existing roadway bridge carrying Myatt Drive over the CSXT right-of-way at Railroad Milepost 000-175.36- OP No. TN0425 Nashville, TN.

WHEREAS, CSX Transportation, Inc. is willing to cooperate with the Metropolitan Government regarding the painting and repairs of an existing roadway bridge carrying Myatt Drive over a CSXT right-of-way at Railroad Milepost 000-175.36 (AAR DOT# 343 814S)-OP No. TN0425 Nashville, TN, pursuant to the terms of the agreement attached hereto (“Agreement”); and,

WHEREAS, the CSXT cost force account estimate for engineering and inspection phase and flagging services is $89,737.00; and,

WHEREAS, it is the purpose of said Agreement to provide for the terms and conditions upon which construction of the Project shall proceed and the parties' obligations with respect to the future maintenance and operation of the permanent aspects of the Project.

NOW, THEREFORE BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section1. That the Agreement for the painting and repairs to an existing roadway bridge over a CSXT right-of-way at Railroad Milepost 000-175.36 (AAR DOT#343 814S)-OP No. TN0425 Nashville, TN attached hereto and incorporated herein, is hereby approved, the Metropolitan Mayor is authorized to execute the same.

Section 2. That any amendments, renewals, or extension of the terms of the Agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this enactment shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
