ORDINANCE NO. BL2015-1312

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 625 linear feet of an 8 inch public sanitary sewer main, on property owned by Welch College located near the intersection of West End Avenue and Bowling Avenue, and to abandon any associated prescriptive easement and to accept 1286 linear feet of an 8 inch PVC public sanitary sewer main and 196 linear feet of an 8 inch DIP sanitary sewer main and associated easement contingent upon the completion of construction of Project No. 15-SL-138, and upon the construction of the new line and flow being switched over (Proposal No. 2015M-039ES-001).

WHEREAS, the abandonment of approximately 625 linear feet of an 8 inch public sanitary sewer main, on property owned by Welch College located near the intersection of West End Avenue and Bowling Avenue, and the abandonment of any associated prescriptive easement and the acceptance of accept 1286 linear feet of an 8 inch PVC public sanitary sewer main and 196 linear feet of an 8 inch DIP sanitary sewer main and associated easement are needed to construct Project No. 15-SL-138; and,

WHEREAS, this abandonment should be contingent upon the completion of construction of Project # 15-SL-138, and the new line must be constructed and flow switched over prior to final abandonment of the sewer line to be abandoned.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon and accept public sewer main and easement on the property located below as shown on Exhibit 1, which is attached hereto and incorporated by reference, contingent upon the completion of construction of Project # 15-SL-138, and the construction of the new sewer line and flow being switched over thereto prior to final abandonment of this sewer line:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonments and acceptances authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
