ORDINANCE NO. BL2015-1309

An ordinance approving a lease agreement by and between The Metropolitan Government of Nashville and Davidson County acting by and through its Board of Parks and Recreation and The Adventure Science Center, for the lease of property at Fort Negley Park (Proposal No. 2015M-027PR-001).

WHEREAS, Resolution No. 67-311 approved a lease agreement between the Metropolitan Government and the Nashville Children’s Museum Association, of certain real property in Fort Negley Park, more particularly described in the lease, for the construction and operation of a children’s museum; and,

WHEREAS, the Nashville Children’s Museum Association is now known as the Adventure Science Center Nashville; and,

WHEREAS, the Agreement approved by Resolution No. 67-311 was for a term of fifty (50) years, beginning on July 1, 1967 with the option for renewal of the Agreement for an additional fifty (50) year period on the same terms and conditions; and,

WHEREAS, the parties desire to extend, amend and restate the lease Agreement pursuant to the terms and conditions as set forth in Exhibit 1 attached hereto and incorporated herein; and,

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve said lease agreement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The lease by and between The Metropolitan Government of Nashville & Davidson County, acting by and through the Board of Parks and Recreation, and The Adventure Science Center Nashville, for the use of property located at Fort Negley Park for a fifty-year term beginning upon approval by Council, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That any amendments to this lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
