ORDINANCE NO. BL2015-1308

An ordinance approving an agreement with Piedmont Natural Gas Company, Inc. providing for the conveyance of property and payment of $159,617 to Piedmont as reimbursement for expenses incurred in the relocation of Piedmont infrastructure in connection with construction of the new minor league baseball ballpark. (Proposal Number 2015M-024PR-001).

WHEREAS, construction of the new minor league baseball ballpark required the relocation (the “Relocation Work”) of certain infrastructure belonging to Piedmont Natural Gas Company, Inc. (“PNG”); and,

WHEREAS, PNG’s costs incurred in connection with the Relocation Work totaled $529,901.40; and,

WHEREAS, pursuant to the terms of the agreement (“Agreement”) attached as Exhibit A to this ordinance, the Metropolitan Government proposes to reimburse PNG for the Relocation Work by paying the sum of $159,617.00 and conveying to PNG three parcels of real property (a portion of Parcel # 08000003500; collectively , the “Property”) totaling 80.28 acres; and,

WHEREAS, approval of the Agreement is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Property is declared to be surplus.

Section 2. The Agreement is approved, and the Director of Public Property or his designee is authorized to execute it on behalf of the Metropolitan Government.

Section 3. The Director of Public Property or his designee is further authorized to execute such deeds and other documents as are customary and necessary to effect the purposes of this ordinance.

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
