ORDINANCE NO. BL2015-1288

An ordinance authorizing the granting of a permanent landscape easement and a temporary construction easement to GBT Realty Corporation on certain property owned by the Metropolitan Government (Tax Map 104-08-0 Parcel 140.00) (Proposal No. 2015M-017PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns certain unimproved property in Davidson County known as 0 Wedgewood Avenue (also known as Davidson County Tax Map 104-08-0 Parcel 140.00) and as shown on Exhibit A; and

WHEREAS, GBT Realty Corporation has requested a permanent landscape and a temporary construction easement for a term of 18 months for parking and storage of construction materials on said property while performing construction work on an adjacent Regions Bank facility; and

WHEREAS, GBT Realty Corporation has agreed, as Grantee, to pay fair market value as compensation for said temporary construction easement and to install new landscaping and to maintain said landscaping on an ongoing basis as described in said easement; and

WHEREAS, the Metropolitan Board of Parks and Recreation maintains the property and has approved the granting of said easement.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The granting of a permanent landscape easement and a temporary construction easement to GBT Realty Corporation for the purpose of parking and storage of construction materials (as described in the attached Exhibit B) is hereby approved.

Section 2. The Director of Public Property Administration is authorized to grant said easement and to execute the necessary documents pertaining thereto.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
