Metropolitan Council Meeting
Tuesday, August 15, 2006


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Councilman Greg Adkins.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Hunt, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Crafton, Evans, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Williams, Tygard and President Gentry (39); Absent: (0).

The Minutes of the regular meeting of August 1, 2006, were approved.

The President announced that an election of a new president pro tempore for a term beginning September 1, 2006 would be held at the next meeting.

Mr. Adkins moved that the regular September 5, 2006 meeting of the Metropolitan Council be moved to August 29, 2006 and that the re-scheduled meeting be deemed as the first regular meeting in September, which motion was seconded and adopted without objection.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmation-Public Elections Committee recommended approval of the following proposed amendment to Rule No. 22 of the Rules of Procedure of the Metropolitan Council:

By adding the following new paragraph:

"All resolutions accepting donations on behalf of departments, boards, and commissions of the Metropolitan
Government shall be automatically deferred one meeting upon being introduced."

Convention Center Commission
Reappointment of Mr. John E. Barker, Sr. for a term expiring June 7, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. William McDonald for a term expiring June 7, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historic Zoning Commission
Reappointment of Mr. R. Allen DeCuyper for a term expiring June 1, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Brian Tibbs for a term expiring June 1, 2007. Without objection, the nomination was deferred.

Hospital Authority

Procurement Standards Board
Reappointment of Mr. David Williams II for a term expiring July 20, 2009. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- BILL ON PUBLIC HEARING -

BILL NO. BL2006-1123

An ordinance amending Title 2 of the Metropolitan Code of Laws authorizing the creation of a Gulch Central Business Improvement District for Metropolitan Nashville and Davidson County, Tennessee, and to appoint a corporation to act as an advisory board to the district with the necessary powers and authority to carry out the purposes and intent of the district. The bill was approved by the Budget and Finance Committee. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Wallace offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2006-1329

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount not to exceed Two Hundred Ninety-Six Million Three Hundred Twenty-Five Thousand Three Hundred Thirty-Two Dollars ($296,325,332) to be financed by the ad valorem levy on property in the General Services District and in an aggregate principal amount of Twenty-Two Million Three Hundred Fifty-Six Thousand One Hundred Fifty Dollars ($22,356,150) to be financed by the ad valorem levy on property in the Urban Services District. The resolution was approved by the Budget and Finance Committee. Ms. McClendon moved to adopt the resolution, which motion was seconded. A resolution appropriating $193,000 in Community Development Block Grant funds to reconstruct public tennis courts at the corner of 16th Avenue North and Phillips Street adjacent to Fisk University and Andrew Jackson Homes. BILL NO. BL2006-1175

An ordinance amending Title 15 of the Metropolitan Code of Laws to reduce residential sewer rates in an amount necessary to reduce the amount of revenue generated by the Department of Water and Sewerage Services by $5.2 million, all as more fully described herein. Mr. Gotto moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1176

An ordinance establishing a program for the purpose of providing assistance to low-income elderly residents of the Metropolitan Government for the fiscal year 2006-2007. Ms. McClendon moved to pass the bill on first reading and refer it to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.
